LeadHeed Fair Use Policy (FUP) / Acceptable Use Policy (AUP)

At LeadHeed (“we,” “our,” “us”), we are committed to ensuring that all users (“you,” “your”) use our platform responsibly, fairly, and lawfully. This Fair Use Policy (FUP), also referred to as the Acceptable Use Policy (AUP), sets out the rules governing appropriate use of the LeadHeed platform.
By subscribing to or using LeadHeed, you agree to comply with this FUP.
LeadHeed reserves the right to update this FUP at any time. Continued use of the Platform constitutes acceptance of any changes.
1. Prohibited Conduct
You must not use LeadHeed for unlawful, fraudulent, abusive, or inappropriate activities. Specifically, you must not:
1.1 Violate any applicable Hong Kong laws, regulations, or statutory requirements, including but not limited to:
- Personal Data (Privacy) Ordinance (Cap. 486)
- Unsolicited Electronic Messages Ordinance (Cap. 593)
- Any other applicable Hong Kong laws that may be enacted or amended in the future.
1.2 Infringe the privacy, confidentiality, or intellectual property rights of any third party, including trademarks, copyrights, patents, or brand identity.
1.3 Attempt unauthorized access, modification, circumvention, or interference with the LeadHeed platform, systems, or infrastructure.
1.4 Engage in harassment, intimidation, discriminatory conduct, threats, or violence.
1.5 Create, distribute, or transmit harmful, offensive, obscene, or abusive content, including pornography, hate speech, or extreme violence.
1.6 Engage in spam, phishing, impersonation, scams, or fraudulent activities.
2. Prohibited Content
You must not use LeadHeed to create, upload, transmit, store, or share content that is:
2.1 False, misleading, deceptive, or inaccurate.
2.2 Promoting hatred, discrimination, harassment, or violence against individuals, groups, or organisations.
2.3 You must not use LeadHeed for unlawful, fraudulent, abusive, or inappropriate activities. Specifically, you must not:
2.4 Containing malware, viruses, spyware, ransomware, or other malicious code.
2.5 In violation of any applicable law, regulation, court order, or industry guideline.
3. Marketing Communications
3.1 Users may opt out of marketing communications at any time using the unsubscribe mechanism provided in such messages.
3.2 Opting out of marketing communications does not affect essential service-related notifications, transactional messages, or security alerts.
4. Prohibited Platform Usage
You must not:
4.1 Reverse-engineer, replicate, decompile, disassemble, or attempt to extract the source code of the Platform.
4.2 Misrepresent your identity or falsely claim affiliation with another person or organisation.
4.3 Attempt unauthorized access to LeadHeed servers, systems, APIs, or user accounts.
4.4 Transmit malware, viruses, spyware, or harmful applications through the Platform.
4.5 Resource Abuse
Including but not limited to:
- Excessive Email volumes or messaging that negatively impacts system performance
- Automated messaging without proper authorisation
- Traffic manipulation or abuse of platform limits
4.6 Data Misuse
- Accessing, attempting to access, or misusing other users’ data without authorisation
- Scraping, crawling, harvesting, or extracting data without express written permission
4.7 Bulk Contact Abuse
Creating, compiling, importing, or using unauthorised bulk contact lists obtained from third parties or other platforms.
5. Enforcement
LeadHeed may investigate any suspected or actual violations of this FUP.
Enforcement actions may include, without limitation:
- Immediate suspension or termination of access
- Removal or deletion of prohibited content
- Limitation of platform functionality
- Reporting unlawful conduct to relevant authorities where required by law
6. Customer Limitations
6.1 Access to LeadHeed services (including Email, messaging, and communications) is conditional upon timely payment of all subscription fees, usage charges, and outstanding balances.
6.2 Failure to pay due amounts may result in restriction, suspension, or disabling of services until payment is received and confirmed.
6.3 Continued non-payment may lead to account suspension or termination in accordance with LeadHeed’s Terms of Service.
7. Customer Obligations
To ensure fair and lawful use, you agree to:
7.1 Use LeadHeed services only for lawful, authorised personal or business purposes.
7.2 Not misuse LeadHeed branding, trademarks, logos, or intellectual property.
7.3 Not resell, sublicense, or allow third-party use of LeadHeed services in violation of this FUP.
7.4 Not engage in dishonest, unlawful, or deceptive practices.
7.5 Protect minors and avoid exposing them to harmful, offensive, or inappropriate content.
7.6 Avoid spreading misinformation, hate speech, or discriminatory content.
7.7 Not bypass platform safeguards, restrictions, or compliance controls.
7.8 Conduct all activities ethically and in compliance with applicable laws and industry standards.
7.9 Users may access the service on one (1) desktop or laptop and up to two (2) mobile devices. Exceeding these limits may result in plan adjustments or access restrictions.
8. Changes to This Policy
8.1 LeadHeed may update this FUP/AUP at its discretion.
8.2 Updated versions will be published on the LeadHeed website or Platform.
8.3 Continued use of the Platform after updates take effect constitutes acceptance of the revised policy.
8.4 If you do not agree with updated terms, you may discontinue use of the Platform.
