Welcome to LeadHeed (“we,” “our,” “us”). These Terms of Service (“Terms”) govern your use of the LeadHeed platform, available at https://leadheed.com (the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use our Platform.

1. Account Registration and User Obligations

The Platform is operated from Hong Kong and is primarily intended for business users. If you access the Platform from outside Hong Kong, you are responsible for compliance with your local laws in addition to Hong Kong laws, where applicable.

You represent that you are at least 18 years old and are using the Platform for business or professional purposes.

We take the security of data processed through the CRM seriously and implement appropriate technical and organisational measures to protect information against unauthorised access, loss, misuse, alteration, or disclosure, in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong (PDPO).

Our data security standards include, but are not limited to:

All data transmitted to and from the CRM is protected using industry-standard encryption protocols. Sensitive data stored within the platform is encrypted at rest using strong encryption standards.

3.2 Access Control & Authentication

Access to CRM data is restricted to authorised users only, using role-based access controls (RBAC). Authentication mechanisms may include strong password policies, multi-factor authentication (MFA), and session management controls.

3.3 Infrastructure & Network Security

The CRM is hosted on secure infrastructure protected by firewalls, intrusion detection and prevention systems (IDPS), and regular vulnerability monitoring.

3.4 Data Segregation & Confidentiality

Customer data is logically segregated to prevent unauthorised cross-access between accounts. Confidential information is handled in accordance with applicable Hong Kong data protection laws.

3.5 Monitoring, Logging & Auditing

System activity is logged and monitored to detect suspicious behaviour, unauthorised access attempts, and potential security incidents.

3.6 Regular Security Testing

We conduct periodic security reviews, vulnerability assessments, and penetration testing to identify and remediate potential risks.

3.7 User Responsibility

Users are responsible for maintaining the confidentiality of their login credentials and ensuring appropriate security measures are applied on their own devices and networks.

4. Email Policy

4.1 Genuine Use

LeadHeed requires all users to use email functionality responsibly and genuinely.
Accounts with high email bounce rates exceeding acceptable limits may be restricted from sending further emails.

4.2 Compliance with Hong Kong Anti-Spam Regulations

Users must comply with:

5. Short Message Service (SMS) System Notifications

5.1 Purpose

By using SMS notifications, you agree to receive alerts regarding tasks, meetings, calls, appointments, or other account-related updates.

5.2 Frequency

SMS notifications are sent according to the notification preferences set in your LeadHeed account. Users may modify these preferences at any time.

5.3 Delivery Limitations

LeadHeed and network providers are not liable for any delays, non-delivery, or errors in SMS message delivery.

6. Use of Services

LeadHeed provides a cloud-based customer relationship management (CRM) and communication platform (“Services”). By accessing or using the Services, you agree to comply with these Terms.

6.1 Scope of Services

The Services may include, without limitation:

The availability of features depends on the plan you select. LeadHeed may modify, enhance, or discontinue any part of the Services from time to time with reasonable notice where required by law.

6.2 No Unlawful or Prohibited Use

As a condition of your use of the Platform, you warrant that you will not use the Platform for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Platform in any manner which could damage, disable, overburden, or impair the Platform or interfere with any other party’s use and enjoyment of the Platform. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Platform.

6.3 High-Risk Activities

The Platform is not intended for, and may not be used in connection with, any high-risk activities, including but not limited to emergency services, life support systems, or any other applications where failure of the Platform could result in physical harm or injury. You agree not to use the Platform for such purposes, and you acknowledge that LeadHeed assumes no liability for any service failure that occurs in these high-risk scenarios.

6.4 Free Trial

LeadHeed offers a 14-day free trial to eligible users.

At the end of the 14-day trial, access to paid features will be restricted unless you manually upgrade your account by selecting a subscription plan and providing valid payment details.

6.5 Subscriptions and Billing

Some Services require a paid subscription. LeadHeed offers monthly and annual billing cycles.

All fees are billed in USD, charged in advance of each billing period, and are exclusive of taxes.

You authorise LeadHeed to charge your nominated credit or debit card for applicable fees. Prices may change from time to time, and LeadHeed will notify you in advance of any pricing updates, which will apply from the next billing cycle.

Taxes may apply depending on your location. You are responsible for any applicable taxes, duties, or governmental charges imposed by your jurisdiction.

6.7 Non-Payment and Suspension

If payment is not successfully processed when due, LeadHeed reserves the right to suspend or restrict access to the Services until payment is received

6.8 Cancellation and Refunds

You may cancel your subscription at any time through your account dashboard. Cancellations take effect at the end of the current billing period. Refunds, if any, are governed by the LeadHeed Refund Policy.

7. Disclaimers and Limitation of Liability

To the maximum extent permitted by applicable Hong Kong law, LeadHeed’s total liability shall not exceed the total fees paid by you for the service in the 12 months immediately preceding the event giving rise to the claim. LeadHeed shall not be liable for any indirect, incidental, special, or consequential damages. However, nothing in this agreement shall exclude or limit liability for personal injury or death caused by LeadHeed’s negligence.

These Terms are governed by the laws of the Hong Kong Special Administrative Region (HKSAR).

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiations. If unresolved, disputes shall be submitted to the courts of Hong Kong.

9. Changes to Terms

LeadHeed may update these Terms from time to time.  Changes will be communicated via the Platform or email.  Continued use of the Platform constitutes acceptance of updated Terms.
